Mediation

If you and your spouse have agreed to divorce and want to dissolve your marriage amicably with out a trial but have not worked out all of the details yourselves then mediation maybe a way to resolve the issues in your case. In Tennessee mediation is required before trial so you have an opportunity to work out the arrangements involving the dissolution of your marriage, but you have even more options.

For example, you have the option of who your mediator is. You have the option of whether you want to attend mediation before a divorce is filed. You have the option to have your attorney present at mediation.

Mediation is a form of alternative dispute resolution. It is conducted by a mediator who is a neutral third party. Therefore, the mediator is not for you or against you. Also, the mediator can not give you legal advice. For example, James Widrig is a Rule 31 Listed Family Mediator so if you choose to use him as the mediator he cannot provide you with legal advice throughout the mediation even though he is also an attorney. A divorce lawyer or divorce attorney can advise you as to what you are settling for in mediation and can inform you whether or not the settlement is in your legal best interests, which is why a lot of people have their attorney at mediation. Mediation can be conducted with the parties in one room or in separate rooms. Normally, in dealing with issues in family law/divorce cases, emotions are high, and it is best to have the parties in separate rooms. If the parties are in separate rooms then the mediator will travel between rooms in order to try and resolve issues in your case.

Mediation has a lot of benefits. Some of those benefits are as follows:

  • Confidentiality- the mediator can not be called as a witness at trial if your case does not settle. Additionally, the mediator can keep things confidential from the other party/spouse, if you tell them you want it to be kept confidential. There are some exceptions to confidentiality, but the family law mediators at Widrig Law PLLC can inform you more about these exceptions before your mediation begins.
  • Cost & Time- Normally, a divorce/custody trial can cost several thousand dollars. A mediator may charge a fee comparable to that of an family law/ divorce attorney, but the mediation process generally takes much less time if your case went through the court system. While a case in the hands of a lawyer or a judge may take several months or years to resolve, mediation usually takes only a matter of a few hours. Therefore, since it takes less time then that means you have to spend less money on hourly fees.
  • Control- in mediation you control the outcome of your case while at a trial the judge makes a ruling that you may, or may not, agree with.
